UNIFUND CCR PARTNERS and J Kurtzer are suing me

Unifund CCR Partners complaint by Jsm1975
Unifund CCR Partners and attorney J Louis Kurtzer are suing me in Summit County Civil Court. My debt is more than 6 years old and was charged off by a company previously. I have done some research on Kurtzer and Unifund and they are buying old unverified debt (valid or not) and trying to get default judgements against people. This is a horrible act. They are abusing the court system to get default judgements and money that is doesn't belong to them!?! How can the judges let this happen? Do the research. Look up J Kurtzer in the Summit County Clerk of Courts and see how many people he and Unifund are suing. It is one of the worst examples of a racket I have ever seen! They are defrauding the people of Summit County and the judges are helping (or at the very least permitting) them to do it! Also look how many complaints they have against them on the Better Business Bureau! Obviously they are not a member with that status. I have hired an attorney and responded, and asked them to verify the debt. I am awaiting their response. If you are also being sued by them, please respond to their complaint or the judge will grant a default judgement against you. Please also bring up the shady past of Kurtzer and Unifund and what they are doing to us the consumer. It is a travesty and they must be stopped. Don't let these debt collectors get away with this scheme! Contact your attorney general, your local politicians, local news providers, and your local consumer advocates about this scheme. If we start speaking up, posting our stories on the internet, and helping each other out, they will have to listen to us.

P.S.- One of the counts they are claiming is "unjust enrichment." How is it that a debt collector paying 4 cents on the dollar is not being unjustly enriched in this process? This is a clear double standard sided against a consumer and for a crooked business.

I filed my answer of denial over a year ago. yesterday I rec'd a copy of the "Order of Non-suit" which was dismissed withou prejudice. Now they can try to take me back to court at a later date. I never signed a contract for financial transactions with Unifund CCR so I denied the charges.

I won... always make them validate your debt AND provide a copy of the original contract with your original signature. Respond to the court in a timely manner and you can beat these bottom feeders.

I have been in touch with the attorney general's office and a couple of local politicians who have shared my concern over how the court system is favoring debt collectors. I am not forgetting this. Don't just sit back and take it... FIGHT! Share your story to help others that have been mistreated... JUST LIKE YOU HAVE! Call your attorney general and call your local politicians now!

I am also being sued by Kurtzer. I don't know much about the debt. However they tell me it is about $6,700.00. I have not been served but am looking at hiring an attorney. I have never applied for a credit card. I let them know. They pretty much just ignored me. I have not heard anything from them.

Do they have the power to touch your bank account. How can they administer a lawsuit without prior notice. This just really let's you see that the cards are stacked in the coprporations favored

I am going through a similar situation. J. Louis Kurtzer was awarded a Default Judgement against me. What's funny is He sent my summons to the hearing to the wrong address. He knew how to find my employer to request a wage garnishment but not where i currently reside, which is 7 hours away from where he filed the suit (What A character). I am currently in the process of filing a motion to have the default judgement vacated or set aside. I cant wait till i have my day in court with this joker. ill keep ya posted

My wife and I beat them today in court to the tune of $5,000. They tried to bring a law suit over a debt paid off more than 6 years ago. We answered their suit within the time frame given, we were given our day in court, and we won. It was dismissed. Ohio law actually has a 4.5 year limitation to the pursuit of any debt upon the first infraction. In other words, if a company does not bring a suit against you within 4.5 years of the initial problem, they can't bring it. We also have to have a signed contract to show there ever was an agreement in the first place. We WON!!! YEAH. DO NOT LET THE FIRST LETTER GO BY WITHOUT AN ANSWER. ANSWER THE SUIT, DO NOT ADMIT ANYTHING BUT YOUR NAME AND ADDRESS, AND REFUTE THE DEBT...

I am in a similar situation with them. What has happened with your case?

after my answer to their interrogatories their answer to my interrogatories(rather non-answers no validation of debt whatsoever) i filed for a summary judgement against them with prejudice(pray I get it) The legal system is not about justice the legal system is about the legal system.
